Terms of Service

1.1 Acceptance of Terms

By accessing or using the Bitpulse website, dashboards, APIs, alerts, or any related mobile/desktop applications (collectively, the “Services”), you (“User”) agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not access or use the Services.

1.2 Eligibility

Users must be at least 18 years old and not located in any jurisdiction where the Services are prohibited by law or regulation.

1.3 Description of Services

Bitpulse is a market‑data publisher that provides statistical risk analytics — including, but not limited to, probabilities of liquidation, volatility metrics, and correlation matrices — derived from publicly available market data and exchange rule sets. Bitpulse does not execute, route, or facilitate trades; hold client funds or assets; or offer personalized investment, tax, or legal advice.

1.4 Registration & Security of API Keys

Users may supply read‑only exchange API credentials to import position data. Users represent that all credentials are accurate, authorized, and limited to read‑only scope. Users remain solely responsible for safeguarding their API keys, account credentials, and any activity that occurs under their account.

1.5 No Investment Advice; Educational Purpose Only

All content is provided for informational and educational purposes on an impersonal basis. Bitpulse makes no representation that any instrument, strategy, or metric is appropriate for any specific individual. Past or hypothetical performance is not indicative of future results. You acknowledge that trading digital assets and derivatives involves substantial risk, including the possible loss of principal.

1.6 Subscription Fees & Payment

Certain features require payment of subscription fees. Fees are billed in advance, are non‑refundable (except as required by law), and may be changed upon 30 days' prior notice.

All software, visual interfaces, graphics, and aggregated analytics are owned by or licensed to Bitpulse and are protected by copyright, trademark, and other laws. No rights are granted except for the limited license expressly set out herein.

1.9 Termination

Bitpulse may suspend or terminate access at any time for violation of these Terms or to comply with applicable law. Upon termination, Sections 1.5, 1.8, 1.10–1.15 survive.

1.10 Disclaimers

THE SERVICES ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. BITPULSE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. BITPULSE DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR‑FREE OR UNINTERRUPTED.

1.11 Limitation of Liability

To the fullest extent permitted by law, Bitpulse will not be liable for (a) lost profits, lost revenues, or indirect, special, incidental, consequential, or punitive damages; or (b) aggregate damages exceeding the greater of (i) fees paid by User in the 12 months preceding the event or (ii) USD 100.

1.12 Indemnification

User agrees to indemnify and hold harmless Bitpulse, its affiliates, and their respective officers, directors, and employees from any claim arising out of User's use of the Services in violation of these Terms or applicable law.

1.13 Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of New York, excluding its conflict‑of‑law rules. Any dispute shall be resolved by binding arbitration under the JAMS Comprehensive Arbitration Rules in New York County, unless prohibited by law.

1.14 Modifications to Terms

Bitpulse may amend these Terms by posting an updated version and issuing notice via the Services. Continued use after the effective date constitutes acceptance.
